1. Our Information

The Site is operated by Ninopath and its affiliates (“we”, “us”, or “our”). References to “you” or “user” mean any person who accesses or uses the Site, including parents, guardians, and prospective employees submitting career applications.

2. Accessing Our Site

We do not guarantee that the Site or any content will always be available or uninterrupted. We may suspend, withdraw, or restrict all or part of the Site for business, security, or operational reasons without notice where permitted by law.

You are responsible for making all arrangements necessary to access the Site and for ensuring that all persons who access the Site through your connection comply with these Terms.

Certain features (such as enrollment, demo requests, or career applications) may require accurate registration information. You agree to provide truthful, current, and complete information and to keep it updated.

3. Intellectual Property Rights

You may link to our home page provided the link is fair and legal, does not suggest sponsorship or endorsement where none exists, and does not damage our reputation. Framing or deep-linking to other parts of the Site requires our prior written approval.

We reserve the right to withdraw linking permission without notice if we consider a link inappropriate.

The Site may include links to third-party websites or services for your convenience. We do not control and are not responsible for their content, privacy practices, or availability. Access to third-party sites is at your own risk and subject to their terms.

8. Limitation of Our Liability

To the fullest extent permitted by law, Ninopath and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunity arising from your use of or inability to use the Site.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or death or personal injury caused by negligence where such limitation is prohibited.

9. Indemnity

You agree to indemnify, defend, and hold harmless Ninopath and its affiliates, officers, and employees from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your user content, or your misuse of the Site.

10. Viruses, Hacking and Other Offences

You must not misuse the Site by introducing malicious code or attempting unauthorised access, interference, or disruption. We may report such activity to relevant law enforcement authorities and cooperate with investigations.

We do not guarantee that the Site will be secure or free from bugs or viruses. You are responsible for configuring your own antivirus and security measures.

11. Variations

We may revise these Terms at any time by posting an updated version on this page. The date of the latest revision may be indicated when we maintain one. Please check this page periodically. Material changes may also be communicated where required by law.

12. Jurisdiction and Applicable Law

These Terms and any dispute or claim arising from them or their subject matter shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.

You agree that the courts located at our principal place of business in India shall have exclusive jurisdiction over such disputes, subject to any mandatory consumer protections in your jurisdiction.

13. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and any program-specific agreements or checkout terms you accept, constitute the entire agreement between you and Ninopath regarding the Site and supersede prior understandings on that subject.

14. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

15. Waiver

No failure or delay by us to exercise any right or remedy under these Terms shall constitute a waiver of that or any other right or remedy, nor shall any partial exercise preclude further exercise of the same or any other right.

16. Assignment

We may assign or transfer our rights and obligations under these Terms to another entity, including in connection with a merger or sale of assets. You may not assign your rights or obligations without our prior written consent.

17. No Partnership or Agency

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Ninopath. You have no authority to bind us in any way.

18. Third Party Rights

These Terms are for the benefit of you and Ninopath. Except as expressly stated, no person who is not a party to these Terms shall have any right to enforce any of its terms under applicable law.

We may give notices to you by email to the address you provide, by posting on the Site, or by other reasonable means. Formal notices to us should be sent to the contact details in Section 20 and marked for the attention of legal or compliance.
